Thailand imposes a strict re-entry ban on foreign visitors who overstay in the Kingdom, according the Order of Minister of Interior, No. 1/2558, Subject ‘Classes of Aliens Ineligible for Admission to the Kingdom of Thailand.’

The Order cited that a number of aliens, or foreign visitors, who have temporary permission to stay in Thailand have overstayed beyond their permitted date, thus placing the safety of people and national’s security at risk.

Therefore, a re-entry ban is now imposed on foreign visitors who violate the Immigration Act: B.E.2522 by overstaying in Thailand.

  • Overstaying more than 90 days to one year, the re-entry ban is one year.
  • Overstaying between 1-3 years, the re-entry ban is three years.
  • Overstaying between 3-5 years, the re-entry ban is five years.
  • Overstaying more than five years, the re-entry ban is 10 years.

Foreign visitors who are apprehended by the authorities for overstaying less than one year will be barred from re-entering Thailand for five years. For those overstaying more than one year, the re-entry ban is 10 years.

The rules of overstay does not apply to foreign visitors who depart Thailand before the age of 18, and those who left the Kingdom before the Order came into effective on 20 March, 2016.
